The Broad-Based Black Economic Empowerment Act No. 53 of 2003, the dti's Broad-Based Black Economic Empowerment Strategy Document and the Codes of Good Practice, provide the legislative framework for the implementation and measurement of broad-based BEE in South Africa.

Broad-Based BEE Act No. 53 of 2003

The Broad-Based BEE Act (BEE Act) provides for the release of a Strategy Document on broad-based BEE, as well as for the drawing up of Codes of Good Practice. It furthers provides for the gazetting of sector transformation charters, under Section 9 or under Section 12.

The dti's Strategy document, entitled South Africa's Economic Transformation: A Strategy for Broad-Based Black Economic Empowerment lays the foundation for the objectives and measurement of broad-based BEE in South Africa.

Codes of Good Practice

The Codes of Good Practice are being developed in two phases. The Codes provide a standardised means of recognition and measurement of broad-based BEE across the various sectors of the economy. This is achieved by means of the dti's Generic Scorecard. An outline of the Scorecard is provided in Code 000, Statement 000, to be up-dated once both phases of the Codes, which cover all seven elements of broad-based BEE, have been completed.

Download the latest version of the first phase of the Codes of Good Practice Currently, the December version of the first phase of the Codes, released for public comment, is the latest version available to the public. A revised, embargoed version was launched on 24 June 2005 and made available to selected private sector stakeholders. It is expected that the final version of the first phase of the Codes will be released to the public in late August or early September.
